GENERAL TERMS AND CONDITIONS OF EURO-UNIT d.o.o. INTERNET SHOPPING

A) VALIDITY OF GENERAL TERMS AND CONDITIONS

A.1.) The relevant provisions of the Civil Obligations Act, the Electronic Communications Act, the Consumer Protection Act, and other applicable regulations of the Republic of Croatia shall apply to these General Terms and Conditions.

A.2.) The General Terms and Conditions, as set out below, constitute a sales contract between an individual customer and company EURO-UNIT D.O.O. (hereinafter: the seller), created by the contract purchase of an individual item through the online store published on the seller's website (hereinafter: www.euro-unit.com).

A.5.) The buyer is any natural or legal person who, through www.euro-unit.com, submits to the seller an offer to purchase of an individual and/or group of products of the seller.

A.6.) All the contracts concluded between the seller and the buyer, and related to the purchase of the seller's products via www.euro-unit.com, are governed by the provisions of these General Terms and Conditions, the laws listed in the preamble to the General Terms and Conditions, and the Personal Data Protection Act.

A.7.) These General Terms and Conditions are published on the website www.euro-unit.com. The buyer has the option and is authorized to store or print these General Terms and Conditions on his own computer system.


B) INVALIDITY OF OTHER CONTRACT CONDITIONS

B.1.) These General Terms and Conditions apply as the primary and mandatory source of law governing the legal relationship between the seller and the buyer and in this regard have a predominant effect over all other possible sources and replace all other written or oral contracts, conditions and/or agreements between the seller and the buyer and/or the contractual terms of other persons, which deviate or may deviate from these General Terms and Conditions. In the event of disagreement between these General Terms and Conditions and all other agreements between the seller and the buyer, these General Terms and Conditions shall prevail, unless the parties agree otherwise in writing.


C) VALIDITY OF NON-CONSUMER RELATIONSHIPS

C.1.) These General Terms and Conditions apply in any case to all persons who, in terms of the legal definition of Croatian legislation of the term consumer, are not considered consumers.


D) VALIDITY OF CONSUMER RELATIONSHIPS

D.1.) These General Terms and Conditions apply to all persons who are considered consumers in terms of the legislation of the Republic of Croatia. These General Terms and Conditions apply from the moment when the buyer declares to the seller that he is fully aware of and agrees with these General Terms and Conditions by confirming the purchase via www.euro-unit.com.


E) VALIDITY OF RELATIONSHIP WITH FOREIGN PERSONS

E.1.) These General Terms and Conditions also apply to persons, whether natural or legal, who have citizenship different from the citizenship of the Republic of Croatia, regardless of any differences in the legal or statutory position of the buyer and regardless of his actual ability to understand the Croatian language in which these General Terms and Conditions were drawn up.

E.2.) These General Terms and Conditions also apply to stateless persons, as well as to the staff of foreign diplomatic and consular missions and to honorary consuls and consulates of foreign countries in the territory of the Republic of Croatia.

F) DELIVERY

F.1.) The seller is obliged to deliver the ordered goods to the buyer at the buyer's address (in front of the door of the building, but not in the building itself or without entering the goods into the building itself) or to the address of a third party listed in the buyer's offer sent via www.euro-unit.com., in which case the third party in question shall be confirmed by the seller's acceptance (with the exception of certain countries, regions or areas where the goods are delivered to the nearest post office - for more details, visit the websites of GLS, DPD, In Time or HP (Croatian Post) delivery services). The buyer agrees on the fact that, if the product needs to be delivered to the buyer's apartment, such a method of delivery will be additionally charged in accordance with the applicable cost estimates and price lists of courier services. Upon receipt of the offer acceptance email, the buyer shall be notified of any delivery costs. Such notice is for informational purposes only and is not binding for the seller.

F.2.) The seller is responsible for timely and orderly shipment of goods from its business units and delivery of suppliers, but is not responsible for delays caused by shipping services, force majeure, as well as for all cases of impossibility and/or delivery delays for which delivery services are responsible: GLS, DPD, In Time or HP (Croatian Post).

F.3.) Where possible, the delivery time of an individual product will be defined and determined to the buyer via a return email or in some other way. The time of delivery by the seller in such an email for the buyer is of an informative nature and does not bind the seller.

F.4.) If the delivery of the purchased goods is not possible at the address indicated by the buyer because the buyer is not currently at the specified address for reasons known to him, the seller is obliged to notify the buyer in writing of the impossibility of delivery. Any costs of the next delivery, as well as all other possible costs due to failed delivery shall be borne exclusively by the buyer.

F.5.) In case of unsuccessful delivery, as defined in point M.4 of these General Terms and Conditions, if the product is not picked up or picked up in one of the contracted offices of the seller, and of which the buyer has not notified the seller in writing, the seller has the right to store the goods of his choice to the buyer risk, in addition to accounting 3% of the invoice amount for storage costs (increased by the value of the VAT) per month and insist on fulfilling the contract, or after setting a subsequent deadline of 15 days to terminate the contract and sell the goods to third parties, in which case the buyer is obliged to pay a cancellation fee in the amount of 20% (twenty percent) of the gross purchase price. The seller reserves the right to charge the buyer for any further damage exceeding the amount of the cancellation fee. In any case, the buyer is also responsible for any damages suffered by the seller due to failed delivery.

F.6.) The product is considered delivered when the buyer or a person authorized by the buyer signs a written confirmation of receipt and delivers it to the seller or hands it over to the delivery service.

F.7.) The buyer must inspect the goods without delay and inform the seller regarding any visible defect within 8 days following receipt of the buyer. Otherwise, the seller is not responsible for visible defects on purchased items.

F.8.) The supplier's selection is the responsibility of the seller, and the seller is solely and exclusively responsible for the choice of supplier.

F.9.) In case of problems regarding the fulfilment of the buyer's payment obligations, the seller may, at his discretion, cancel the delivery of the goods or postpone it until the fulfillment of payment obligations by the buyer.

F.10.) www.euro-unit.com uses the services of the following delivery services: GLS, DPD, In Time and HP (Croatian Post), and all the details concerning their services, availability of delivery, delivery to the islands, deadlines and all other information can be found on their official websites: GLS, DPD, In Time, HP (Croatian Post).

G) WARRANTY

G.1.) If so stated on the warranty card and/or invoice delivered to the buyer after the sale, the warranty on the goods is valid for the term stated on the warranty document itself, and the mandatory warranty is valid under legal conditions.

G.2.) The warranty conditions are valid from the day of delivery of the goods to the buyer, and the seller guarantees to the buyer that the product will function properly during the warranty period, if the buyer follows the instructions for use.

G.3.) The buyer is obliged to inspect the goods without delay and notify the seller within 8 days of any visible defects in the goods. Otherwise, the seller is not responsible for visible defects on purchased items.

G.4.) The buyer shall declare any hidden defects of the goods to the seller within 8 (eight) days of discovery of the same, otherwise he loses his right to act on the same. After the expiration of 6 (six) months from the delivery of the goods, the seller is released from liability for invisible defects.

G.5.) If the buyer has duly notified the seller of the defects (visible and hidden), within the legally prescribed time limits, the seller has the following obligations to the buyer:

  • elimination of the defect
  • replacement of goods by other goods without defect
  • reducing the purchase price
  • enabling termination of the contract

In terms of Article 410 of the Law on Obligations, all these rights are given individually and alternatively and are not applied all at once, i.e. because of the impossibility of fulfilling one of the options, the other becomes active etc.

G.6.) In the case of replacement of a product with another product in case of observed defects, the seller is obliged to organize the gathering of the product at the buyer's address and delivery of the replacement product at the seller's expense. The product replacement must be completed within the legal deadline.

G.7.) After the expiration of the warranty period prescribed in the warranty card, regardless of the timely notification of the buyer of defects by the seller, the seller is no longer liable for any defects.

G.8.) The seller assumes no responsibility for any damage caused as a result of ordinary negligence of the buyer or persons to whom he is responsible. This applies in particular to any further damage. The buyer gives his explicit consent to the exemption of Art. 345/2 of the Law on Obligations, that is, he waives his right to judicial rebuttal of this provision of the general conditions of sale and delivery of goods. The buyer confirms that this provision is not a consequence of the monopolistic position of the seller and/or the unequal attitude of the contracting parties. The buyer waives the right to contest the sales contract due to violation of the principle of equal value of the benefit.

G.9.) If it is established that the goods under warranty that the buyer advertises as defective are undamaged, the seller reserves the right to charge for inspection of the said product according to the valid price list of the authorized service, with any additional costs of product delivery (if at the seller's expense) and return of the correct product to the customer.

H) RIGHT OF WITHDRAW AND RETURN OF THE GOODS

H.1.) The buyer or the consumer has the right within 30 days from the date of delivery of goods, to unilaterally terminate the purchase contract and to deliver a written notice of termination before the deadline defined for unilateral termination to the seller's address: Euro-Unit d.o.o., Ulica braće Graner 8, 40 000 Čakovec, Croatia, stating to note: Internet sales department. H.2.) In the case of concluding an purchase, the period referred to in paragraph 1 of this Article shall run from the day when the goods that are the subject of the contract were handed over to the buyer or a third party designated by the buyer, other than the carrier.

H.3.) The direct cost of reimbursement of the goods are be borne by the buyer. In the case of a registered consignment, the seller reserves the right to reduce the cost of redemption in proportion to the purchased product.

H.4.) The buyer is obliged to prove that he has exercised his right to unilaterally terminate a contract in accordance with the provisions of the General Terms and Conditions.

H.5.) In the event of termination of the contract, each party is obliged to return to the other party what it received under the contract, in accordance with the provisions of this paragraph. This means that the seller returns the funds using the same means of payment used by the buyer when paying, and the buyer returns the purchased goods without delay, packed in the preserved and undamaged original packaging, and no later than 14 days from the date on which he/she informed the seller of his decision to terminate the contract. The seller is not obliged to agree to terminate the contract of sale if the purchased product is not returned in the original undamaged packaging.

H.6.) The buyer is not entitled to unilaterally terminate the contract of sale in cases defined by Article 79 of the Consumer Protection Act (NN 41/14).

DOCUMENTS REQUIRED FOR RETURN OF GOODS



I) PAYMENT

I.1.) Unless otherwise explicitly stated, the payment currency of the web store is Croatian kuna (HRK). Prices include value added tax (VAT). Prices do not include shipping costs, customs, handling and other costs.

I.2.) The internet system www.euro-unit.com allows its users to pay by credit or debit card, cash on delivery, internet banking, bank transfer and PayPal in accordance with the conditions set out in these General Terms and Conditions.

I.3.) After selecting the appropriate payment method, the buyer is no longer authorized and waives the right to cancel or change the default forms through which the payment is made.

I.4.) The buyer agrees that the seller, in his sole discretion in case of suspicion of misuse of any type of payment, can and is expressly authorized to suspend any such transaction without prior notice and submit all relevant information to the competent authorities to prosecute potential perpetrators.

I.5.) If the buyer is unable for any reason to pay the purchase price, the seller is entitled to unilaterally cancel the purchase process. In this case, the buyer is liable to the seller for all damages and costs that the seller may have in doing so.

I.6.) The buyer confirms that his payment service provider, for the purpose of fulfilling the buyer's payment obligations to the seller in connection with the purchase of certain seller's products may charge the buyer with transaction costs which are not known to the seller at the time of advertising a product, making the offer to the buyer, as well as at the moment of the conclusion of the sales contract. The buyer agrees to bear all such costs.

I.7.) Deliveries to countries not members of the European Union (EU) exclude value added tax (VAT)! Possible import duties are paid upon arrival of the shipment in the country of destination. If the buyer is a person who is not a citizen of one of the EU Member States, the possibility of deducting input tax is assessed in accordance with the applicable international agreements on the avoidance of double economic taxation. The Seller does not bear any responsibility for the refund of value added tax and / or other applicable taxes of the Buyer, nor does it assume any obligation of any kind to assist the Buyer in the refund of Value Added Tax and / or other applicable taxes.

I.8) The web store currency of www.euro-unit.com is the Croatian Kuna (HRK). All prices in foreign currencies are for information purposes only! The amount for which the customer's credit card will be charged is obtained through the conversion of the price from the Euro into Croatian Kuna according to the valid exchange rate of the CNB (Croatian National Bank). When charged with the buyer's credit card, the same amount is converted to buyer's local currency according to the valid exchange rate of the card association. As a result of the price conversion, there is a possibility of a small difference in the amount compared to the original price displayed on our web store.

I.9.) When paying for the seller's product with the buyer's credit or debit cards, the payment service provider will charge the customer for the amount of the purchase price and other related costs immediately after sending an e-mail by www.euro-unit.com to the buyer about accepting his offer by the seller.

I.10.) Upon receipt of the order for execution of payment using credit or debit card of the buyer, the buyer waives any right to terminate, cancel and/or change the execution of the order. In this regard, the buyer is responsible for all costs and damages that may be incurred by the seller.

I.11.) The buyer is responsible to ensure that the service provider's credit or debit card provides sufficient liquidity for the execution of the purchase price and all other applicable costs. This relationship is governed by the rules between the payment service provider and the customer, and the customer is required to provide complete and accurate credit or debit card information through the order. Otherwise, the buyer is liable for all damages and costs incurred or may be incurred by the seller in relation to the violation of this buyer's obligation.

I.12.) The seller does not record the buyer's credit card number or store transaction information. The seller uses credit card services from a third party, an authorized bank, or a billing service provider that protects the buyer's data by encryption.

I.13) The entry and transmission of personal and credit card number data is protected by the 256 bit SSL encryption provided by the service provider via the online credit card authorization system. Credit card authorization and billing is done using a real-time card authorization and billing system.

I.14.) The Seller undertakes to protect the personal data of the buyer in accordance with the Personal Data Protection Act and undertakes not to disclose the personal data to third parties in any way without the consent of the buyer. Exceptions are data necessary for the delivery of the purchased product and the like. Exceptions to this are cases in which the seller, by a valid order of the authorized state bodies and in accordance with the law, is obliged to submit or allow access to the buyer's personal data.

I.15.) The buyer has the right to request the addition, correction or modification of incorrect personal data.

J) FORMS OF PAYMENT

M.1.) Electronic devices contain several hundred different materials. Some of them are reusable after the service life of the device, but many substances can be very harmful if electronic waste is handled improperly. In order to prevent the harmful impact of these substances on the environment and human health, it is very important that EE waste is collected separately from municipal waste and then disposed of in an environmentally friendly manner.

M.2.) How to get rid of EE waste? In the Republic of Croatia, there is an organized free system for the disposal of EE waste through authorized collectors. Just call the toll-free number 0800 444 110 or send an SMS to 098 444 110 and if you have more than 30 kg of EE waste, an authorized collector will pick it up at your address. You will receive all the necessary additional information on the same number. M.3.You can also take EE waste in person to the nearest recycling yard.

N) OTHER PROVISIONSE

Any contract concluded on the basis of these General Terms and Conditions will be stored in electronic form with the seller, and the buyer can access the contract at the request of the seller by paying the actual material costs of each reproduction and delivery.
